1. Package Terms
a) Yuplus Studio reserves the right to accept or reject an application for any reason whatsoever. The Clients and their Family Members are subjected to the Studio Rules and Regulations in force.
b) Packages are personal to the Clients and is non-transferable and non-refundable and non-exchangeable.
c) Upon acceptance of the Client's application, the Client will be issued with an account, and the Client shall be entitled to all the rights and privileges exercisable within the class.
d) The Clients and Family Members agrees that he/she are of legal age, has the capacity, and has voluntarily entered into this agreement and accept all terms & conditions of any Packages of Yuplus Studio. If the Clients or Family Members are not of legal age, the Clients or Family Members has obtained the consent of the guardian to enter into this agreement.
e) Shareability of packages may vary, and clients are advised to review the specific terms outlined for each package regarding the sharing of benefits with others.
f) For shareable packages, clients are permitted to share their credits with one designated family member. Bookings must adhere to the following conditions:
i) Single Booking: Only the package owner can make a reservation for themselves.
ii) Dual Booking: When booking for two, both the package owner and the designated family member may attend. The package owner must be present; credits for two individuals will be deducted accordingly.
Bookings for others without the presence of the package owner are not permitted.
2. Shareable Package Policy Violation
a) For shareable packages, the designated family member is only allowed to attend classes when the package owner is present.
i) If we discover that a class was attended without the package owner present, credits for two persons will still be deducted — one for the attending family member or friend and one for the package owner, even if they did not attend the class.
ii) Example: If you book a class for your friend but do not attend, and your friend still joins the class, this violates the shareable package policy, and your credit will still be deducted as if both attended.
b) Repeated violations of this policy will result in account termination without prior notice. The studio reserves the right to enforce this rule strictly to maintain fairness and uphold policy integrity.
3. Package Termination
a) The Studio reserves the right to terminate the Package of any Clients or Family Members found to be in breach of any Terms and Conditions/Centre Rules and Regulations. The Clients shall not be entitled to any refunds.
b)The Clients are not entitled to any refund if they terminate their package solely because one of the teachers is no longer teaching at the studio.
4. Physical Conditions of Clients and Family Members
a) The Clients and Family Members hereby warrants represents and agrees that he/she has no physical disability, impairment or ailment preventing him/her from engaging in any exercise activity, or that will be detrimental to his/her health, safety, comfort, or physical condition, or that of others.
b) The Clients and Family Members fully understands that he/she is engaging in physical exercise and training and instruction by The Studio’s personnel, which may cause injury or a risk of abnormal body changes to him or her. He/she hereby agrees that he/she is a voluntary participant in physical exercise, the use of any facility of the Studio, training and instruction by the Studio’s personnel and that he/she is assuming all risks of injury or of abnormal body changes to him/her on account of these activities.
c) The Studio shall not be liable or responsible for any injury or abnormal body changes caused as a result of the use of the Studio facilities and training and instruction by the Studio’s personnel.
d) The Client and Family Members shall not use any studio facilities whilst suffering from any infections or contagious illness, disease or other ailments such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other clients.
e) Pregnant clients must inform the Studio of their pregnancy status before engaging in any exercise activity. Pregnant clients must also obtain clearance from their healthcare provider before participating in any exercise program at the Studio. The Studio reserves the right to modify or restrict exercise activities for pregnant clients based on medical advice to ensure the safety and well-being of both the client and the unborn child.
5. Expulsion of Clients
(a) Yuplus Studio and/or the management may terminate the package of any Client:
(i) without notice and with immediate effect if the Client and Family Member’s conduct, whether or not such conduct is the subject of a complaint by another client or clients, such that in the opinion of the management, and conduct may be injurious to the interests of the company.
(ii) without notice and with immediate effect if the Client or/and Family Members shall have committed any breach of these Terms and Conditions or of the Studio’s Rules and Regulations that are in force at the material time.
(iii) with and/or without notice and with immediate effect, if the Studio is of the opinion that the client is not a suitable individual for continued package. All decisions of the management under this clause are final and binding.
(iv) without notice and with immediate effect if a member is found to have violated the privacy of any other member within the shower and the changing rooms, or are caught in lewd or compromising actions
(b) The company has the right to terminate any package with or without notice/explanation. A client whose package is terminated by the management shall forfeit all the privileges with immediate effect.
(c) Please treat our staff and fellow yogi members with respect. We aim to provide a safe environment for our staff and clients, therefore, we expect all Clients and Family Members to respect the rights of staff and of other clients. The use or threat of force against our staff, or any attempt to do so, is unacceptable. Aggressive or abusive behaviour against our staff is unacceptable. This includes swearing, threatening or abusive language or gestures, sexual gestures or behaviour, derogatory sexual or racial remarks, shouting loudly or in an intimidating manner or at any person, and applying force to any studio property or the personal property of any staff, such as banging on or kicking desks or counters.
The Studio can terminate any package with or without notice/explanation and with immediate effect if Clients or/and Family Members is found to have been disrespectful to our staff.
6. Dress Code
a) Proper attire, including suitable exercise clothing and footwear, must be worn during classes for safety and hygiene reasons.
7. Class Bookings and Schedule
a) Clients are required to book all classes in advance, no later than 2 hours before the start of class. This applies to both private and group sessions, and all bookings are subject to availability.
b) In the event that Yuplus Studio needs to cancel a class, course, or workshop, clients will receive notification via email at least 2 hours in advance. Yuplus Studio shall not be held responsible for clients who attend a cancelled class due to failure to check their email.
c) Cancellations must be requested by the Clients at least 12 hours before the scheduled class time. Failure to cancel within the specified timeframe will result in the forfeiture of credits. Late cancellations or no-shows will not be eligible for refunds.
d) For cancelled workshops or special classes by the Studio, the Clients will receive a full refund.
e) In the case of cancelled classes by the Studio, credits will be refunded back into the client's account.
f) Classes must be reserved in advance and are subject to availability. Clients who do not pre-book classes and walk in will be subject to the walk-in rates of RM60 for aerial yoga, aerial hoop, mat Pilates, and mat yoga, and RM120 for reformer Pilates.
g) Clients and/or Family Members are obligated to arrive punctually for scheduled classes. Late arrivals may be refused entry and could lead to the forfeiture of credits allocated for that session.
8. Studio Facilities
a) Clients and Family Members are responsible for using the studio facilities safely and appropriately. Any damage to studio property caused by misuse or negligence may result in financial liability.
b) Clients and Family Members must maintain cleanliness and hygiene standards while using the studio facilities. This includes wiping down equipment after use and disposing of any waste properly.
c) Clients and Family Members should promptly report any maintenance issues, equipment malfunctions, or safety concerns to studio staff.
d)Access to studio facilities may be restricted or modified at the discretion of the Studio for reasons such as maintenance, renovation, or special events.
e) Clients and Family Members are responsible for their personal belongings. The Studio is not liable for any loss, theft, or damage to personal property left unattended in the studio facilities.
f) Clients and Family Members must comply with all studio rules and regulations, as well as any instructions provided by studio staff regarding the use of facilities.
g) The Studio reserves the right to terminate or suspend access to studio facilities for clients or Family Members who violate these terms and conditions or engage in behavior deemed disruptive or unsafe by studio staff.
9. Recording and Photography Policy
a) Students may record or photograph themselves during class for personal reference, provided it does not disrupt the session.
b) Students must ensure no other participants are captured in any recordings or photographs without obtaining their explicit consent.
c) If other students appear in a recording without consent, the studio and instructors reserve the right to request deletion of the footage to protect participant privacy.
d) The studio may occasionally take photos or videos for promotional purposes. Students will be informed in advance and have the option to opt out if they do not wish to be included.
10. Limitation of Liability
In consideration for the Management and Studio accepting his/her application and for him/her becoming and remaining a Client, the Client agrees that:
a) Neither Yuplus Studio, its employees or staffs shall be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage or theft to a Client and/or Family Member’s person or property arising out of, or in connection with the use by a Client and/or Family Member of any of the services, facilities or premises of Yuplus Studio. The Clients and Family Members hereby does not hold the Studio, its related employees and staffs harmless from all claims which may be brought against them by or on a Clients and/or Family Member’s behalf for any such injuries or claims aforesaid.
b) Any Family Members of a member or temporary visitor to Yuplus Studio agrees to abide by the same studio rules and regulation, and the same terms and conditions as a client.
11. Liability Waiver
The Client acknowledges that by signing below, they fully understand and accept the terms of this Release of Liability and Consent. This Release serves as a waiver of any and all future claims against Yuplus Studio, including but not limited to injuries or risks resulting from activities while utilizing the Studio's facilities and/or participating in classes.
By signing up for services with Yuplus Studio, the Client consents to Yuplus Studio and its related entities collecting, using, and disclosing their personal data, and sharing such data with business partners for marketing and promotional purposes. This consent may be withdrawn at any time through forms available at Yuplus Studio branches.
The Client also agrees to be contacted by Yuplus Studio via telephone call and/or SMS for marketing purposes. Additionally, they agree to abide by the Studio's terms and conditions and studio rules and regulations, as outlined on the Yuplus Studio website.
The Client acknowledges that Yuplus Studio is not responsible for the safekeeping of personal belongings while attending class. They understand that classes at Yuplus Studio may be physically strenuous and voluntarily participate with the knowledge of the risk of personal injury, property loss, or death.
By signing up in the website and giving their signature on the Sign Up page, the Client agrees not to hold Yuplus Studio or its employees and staffs liable for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise. They also consent to the use of their image and likeness by Yuplus Studio for marketing purposes.
The Client acknowledges that the use of Yuplus Studio facilities and services may involve hazardous activities and assume all associated risks. They represent that they are in good health and have no conditions that would prevent them from safely participating in activities provided by Yuplus Studio.
The Client releases Yuplus Studio from any liability for injuries or damages arising from the use of facilities, services, or occurrences in or around Yuplus Studio premises. They further agree to resolve any disputes through mandatory binding arbitration and waive rights to trial by jury or participation in class or collective actions.
This Release is intended to be interpreted broadly and applies to all incidents occurring on Yuplus Studio premises or during events organized by Yuplus Studio. By accepting this Release electronically, the Client certifies that they have carefully reviewed and fully understand its terms.
